1.1. These Terms and Conditions (hereinafter referred to as ‘T&C’) regulate the rights and obligations between AD Development s.r.o., with its registered office at Diakovce 331, 925 81 Diakovce, Company ID: 56 626 355, VAT ID: 2122369733 (hereinafter referred to as ‘Provider’) and customers using services provided under the KovacsDesign brand (hereinafter referred to as ‘Customer’).
1.2. The Provider offers graphic services, including photo retouching, web design, video editing, and other creative services.
1.3. All services provided by the Provider are intended for customers in Slovakia and abroad.
2.1. The scope of services includes delivering graphic, design, video editing, and related services based on the Customer’s requirements.
2.2. Final products are delivered electronically via email or cloud storage. If the Customer requires printing or finalization, the products will be delivered via courier services.
2.3. The Provider guarantees the quality of the services and their execution according to mutually agreed conditions.
3.1. Orders can be placed via email, a contact form on the website, or another agreed method.
3.2. The contractual relationship is established upon confirmation of the order by the Provider.
3.3. The Customer is required to provide all necessary materials, inputs, and specifications needed to execute the service.
4.1. The price for services is determined based on the Customer’s requirements and mutual agreement.
4.2. Payments are made in advance, amounting to 50% of the agreed price, or in full, depending on the agreement.
4.3. Membership Discounts:
– The Customer receives a 5% discount after reaching a cumulative turnover of EUR 2,000.
– Additional discounts may be offered through agreements or loyalty programs.
4.4. Prices are stated excluding VAT.
5.1. Outputs are delivered electronically in a format specified by the Customer (e.g., PNG, JPG, PDF, PSD).
5.2. Before final delivery, the Provider sends drafts for the Customer’s approval. The Customer is entitled to a maximum of [number] revisions, depending on the agreement.
5.3. Upon approval of the design, the service is considered completed, and the work is deemed delivered.
6.1. Complaints are not accepted for services such as design, graphics, or video editing since the Customer has the opportunity to approve the work before its completion.
6.2. Complaints are only possible in cases of defects or errors in printing or finalization. The Customer must report such issues within 7 business days of delivery.
7.1. The intellectual property rights to the created designs or other outputs remain with the Provider until full payment is received.
7.2. After payment, the license to use the work transfers to the Customer unless otherwise agreed.
8.1. The Provider processes the Customer’s personal data in accordance with the GDPR regulation (EU 2016/679).
8.2. Personal data is used solely for the purposes of fulfilling the order and providing services.
8.3. The Provider commits not to share the Customer’s personal data with third parties, except for entities involved in delivery (e.g., courier services) or order processing (e.g., cloud storage providers).
8.4. The Customer has the right to access, correct, or delete their personal data.
9.1. These T&C are valid and effective as of the date of their publication on the KovacsDesign website.
9.2. The Provider reserves the right to update these T&C at any time, with the current version always available on the website.
9.3. Legal relations between the Provider and the Customer are governed by the laws of the Slovak Republic.
